Battery service package with authorised representative – industrial, electric vehicle, LMT and starter batteries (2026)

Since 18 August 2025, every producer without an establishment in Germany must appoint an authorised representative before placing batteries on the market. Since 15 January 2026, every registration in the battery register must also be assigned to an approved producer responsibility organisation (OfH). This package covers both – for industrial batteries, electric vehicle batteries, LMT batteries and starter batteries.

Which battery categories this package covers

Since 7 October 2025, the German Battery Act Implementation Act (BattDG) distinguishes five battery categories. This package applies to the four commercial ones:

• Industrial batteries – for industrial applications, stationary energy storage and systems in commerce and infrastructure
• Electric vehicle batteries – traction batteries in electric and hybrid vehicles
• LMT batteries – batteries for light means of transport such as e-bikes, pedelecs and e-scooters
• Starter batteries – starter, lighting and ignition batteries (SLI)

Registration is per category and chemical system

The stiftung ear does not register your company as a whole. It registers each combination of brand, battery category and chemical system separately. A company selling lithium-ion industrial batteries and lead-acid starter batteries under the same brand needs two registrations. This package includes one; each additional registration costs 69 €.

Scope of services

• Authorised representative under the BattDG for one calendar year
• Registration in the battery register of the stiftung ear – one brand, one battery category, one chemical system
• Joining an approved producer responsibility organisation (OfH) – the admission is included in the price
• Volume reports during the contract term – monthly or annually, depending on the battery category
• Ongoing communication with the stiftung ear and the Federal Environment Agency
• Support with your information obligations towards end users

Your contracting party and invoicing entity is ECOPV-EU GmbH, established in Eschborn. We arrange your connection to an approved producer responsibility organisation (OfH); the admission is included in the package price. You do not need a second contracting party for it.

Scope and conditions

Admission to the OfH is included in the package price; the volume-based fee is not. That fee is billed per kilogram of the batteries you report and depends on the battery category and chemical system. We show it separately rather than folding it into a flat rate that would be too high for most customers.

Who is this package for?

• Producers and importers without an establishment in Germany who supply industrial, electric vehicle, LMT or starter batteries to Germany
• Suppliers of energy storage systems, e-bikes, e-scooters and electric vehicles – including where the battery is permanently built in
• Companies whose ear account was blocked on 15 January 2026 because the OfH assignment was missing

A VAT registration, a warehouse or a fulfilment service provider do not constitute an establishment. Without an establishment, the authorised representative remains mandatory.

Frequently asked questions

I sell e-bikes. Which category is that?

Under the BattDG, batteries for light means of transport are a category of their own (LMT batteries) and therefore fall under this package. The e-bike itself may additionally be subject to the ElektroG – the relevant services are listed under Electrical equipment (ElektroG / WEEE).

How long does registration take?

We submit within 3 working days once your documents are complete – that is the part we control. Expect 6–8 weeks until the stiftung ear grants the registration. That timing rests with the authority and is not a guaranteed outcome.

What does the OfH membership include, and what does it not?

Admission to an approved OfH is included – you do not pay that contribution on top. What is not included is the volume-based fee, charged per kilogram of the batteries you report. It cannot be flat-rated responsibly: an industrial battery weighs many times more than a portable one, and the rates differ by battery category and chemical system. You receive the rate that applies to you before your first report.

What about the deposit on starter batteries?

The deposit is charged by the distributor when selling to end users who do not return an old battery. It is an obligation at the point of sale and is not part of this package.

My ear account was blocked. Can you resolve that?

Yes. On 15 January 2026, accounts were blocked where the chemical system, tax ID or OfH assignment was missing. We add the missing details and carry out the assignment. Tell us when booking that an existing account is affected.

What happens without registration?

The BattDG provides for fines of up to 100,000 € per infringement, plus a ban on distribution until registration and OfH participation are demonstrated. Your own distributors also commit an offence if they resell unregistered batteries – which is why they ask for your registration number in their own interest.
