In short
With a branch in Germany you may register with stiftung ear yourself – you do not need an authorised representative. The obligations remain unchanged: WEEE registration before the first sale, an annual guarantee certificate, monthly quantity notifications and the take-back of waste equipment. This package takes the entire handling off your hands for one calendar year.
It also includes the insolvency-proof guarantee under § 7 ElektroG – from our own producer guarantee system approved by stiftung ear. You need neither a bank guarantee nor an insurance policy for it.
Is this package right for you?
- Yes – your company has a branch in Germany, regardless of where the head office is.
- Yes – you place electrical equipment on the German market for the first time: as a manufacturer, importer or under your own brand.
- Yes – you want to hand over the correspondence with the authority and the reporting entirely.
- No – you have no German branch. An authorised representative is then required by law: Service package with authorised representative.
- No – your equipment is pure B2B equipment. Please contact us first.
Branch or merely a registered office abroad – why this decides the price
§ 8 ElektroG refers to the branch (Niederlassung), not the registered office. A company incorporated abroad with a German branch does not need an authorised representative and is better off with this package. Conversely, a German VAT number, a warehouse or a fulfilment service provider are not enough – none of these is a branch. If you are unsure, we check your situation before you book.

What marketplaces and authorities want to see before your first sale
- A valid WEEE registration number – Amazon, eBay, Kaufland, OTTO and TEMU only release electrical items once verified; marketplace operators must check their sellers' registration.
- Proof of the insolvency-proof guarantee – without it, stiftung ear will not issue a registration for B2C equipment types.
- The WEEE number in business correspondence – legal notice, product pages and invoices.
- Equipment marking – the crossed-out wheeled bin symbol and the information duties towards consumers.
What happens if the registration is missing
- Fines of up to EUR 100,000 per infringement.
- Sales ban until compliance is fully demonstrated; marketplaces usually block the listings immediately.
- Confiscation of profits – turnover and profits from unregistered products can be seized.
- Competition-law warning letters from competitors, with legal and court costs.
- Revocation of an existing registration if the guarantee certificate is not renewed annually.

Process and deadlines
- Booking in the shop. With your purchase you grant us the authority required for the handling.
- Data collection. Company data, brand and equipment type. We check the classification before the application is filed.
- Guarantee certificate. Admission to our approved producer guarantee system – without this certificate stiftung ear will not register you.
- Application in the ear portal. Once your documents are complete we file within 3 working days and handle the correspondence from there. The processing time after that is decided by stiftung ear.
- During the year. Notification obligations, deadline monitoring and collection coordination are on us.
Important: the registration must be in place before your first sale. The ElektroG has no de-minimis threshold – the obligation applies from the very first unit.

Frequently asked questions
I have a branch – do I still need the insolvency-proof guarantee?
Yes. The guarantee under § 7 ElektroG depends on the equipment type, not on the branch: it is mandatory for all B2C equipment types and must be evidenced annually. It is included in this package.
What do I still have to do after booking?
Report your actual quantities. You tell us the weights placed on the market; we handle the notification to stiftung ear. If brand, equipment type or company data change, let us know – we file the report with the authority.
We are a German GmbH of a foreign parent company. Which package applies?
What matters is who first places the equipment on the market. If the German company does so, this package is the right one. If the foreign parent places the equipment directly and has no branch of its own, it needs an authorised representative.
I am already registered with stiftung ear. Can I switch?
Yes. An existing registration stays in place; what changes is the guarantee system. Switching is easiest at the turn of the year, because the guarantee certificate has to be renewed annually anyway.
My device contains a battery. Is that covered?
No – equipment and battery are two separate registrations. The ElektroG applies to the equipment, the BattDG additionally to the battery it contains. Matching services: Batteries (BattDG).
What counts as B2C if I sell to businesses?
What matters is the possible use, not the buyer. Equipment that could also be used in private households counts as B2C – even when sold exclusively to companies. Mixed use („dual use“) is likewise classified as B2C.
What does a collection cost me on top?
The handling is included in the package, the disposal costs are not. Containers, transport and treatment are charged as incurred; the amount depends on equipment type, quantity and collection group.
A fixed price exists only for four equipment types: large equipment, small equipment, small IT and telecommunications equipment and photovoltaic modules, each up to 5 t annual input (ElektroG disposal under 5 t). For temperature exchange equipment, screens and lamps there is no flat rate – refrigerants, screens and mercury make treatment costly and volatile in price.
From 5 t annual input we tender the combined quantities of all participating customers (ElektroG disposal over 5 t). That improves the terms – you still bear the recycling costs as incurred.
How long does it take to get the WEEE number?
We file within 3 working days once your documents are complete. The review itself is with stiftung ear and takes about one month in our experience – an empirical value, not a guarantee. Plan your market launch accordingly: you may not sell before the number has been issued.
What happens at the end of the year?
The price applies per calendar year. We contact you in good time before expiry to renew. If you permanently cease placing equipment on the market, we handle the notification to stiftung ear (§ 6 (1) sentence 4 ElektroG). The deregistration itself is a separate service – its price includes the official stiftung ear fees.
