In parallel, the EU Packaging Regulation PPWR (EU) 2025\/40 applies directly.\u003c\/p\u003e\n\u003ch2\u003eWhat counts as packaging subject to system participation\u003c\/h2\u003e\n\u003cp\u003eSubject to system participation are sales and grouped packaging that \u003cstrong\u003etypically ends up as waste at private end consumers\u003c\/strong\u003e. In distance selling this covers practically all packaging that arrives at the customer with the goods:\u003c\/p\u003e\n\u003cul\u003e\n\u003cli\u003eshipping boxes, cushioning material, bubble wrap and adhesive tape\u003c\/li\u003e\n\u003cli\u003eproduct packaging: folding boxes, blisters, bags, films and labels\u003c\/li\u003e\n\u003cli\u003egrouped packaging that combines several sales units\u003c\/li\u003e\n\u003c\/ul\u003e\n\u003cp\u003eFor each of these you need a LUCID registration number and a system participation contract. Both are publicly visible – marketplaces and competitors can check them at any time.\u003c\/p\u003e\n\u003ch2\u003e§ 5 VerpackDG: appointing third parties and authorised representatives\u003c\/h2\u003e\n\u003cp\u003e§ 5 VerpackDG implements Art. 45(3) PPWR. Four points from it affect you directly:\u003c\/p\u003e\n\u003cul\u003e\n\u003cli\u003e\n\u003cstrong\u003eThe authorised representative counts as the producer.\u003c\/strong\u003e With regard to the obligations to be performed it “counts as the producer within the meaning of this Act” and fulfils them \u003cstrong\u003ein its own name\u003c\/strong\u003e – not merely as a messenger.\u003c\/li\u003e\n\u003cli\u003e\n\u003cstrong\u003eOnly one authorised representative per producer.\u003c\/strong\u003e “Each producer may appoint only one authorised representative for extended producer responsibility.” If you have already named one, it must be replaced first.\u003c\/li\u003e\n\u003cli\u003e\n\u003cstrong\u003eWritten power of attorney in German\u003c\/strong\u003e, signed by both parties by hand or with a qualified electronic signature.
